This document contains the general conditions of sale and online payment through the website corresponding to the domain name www.jeunesseboutique.com ("Site") owned and managed by JEUNESSE S.r.l., with registered office in Pescara in Via Liguria 1/2, VAT and Tax Code 01183990686, registration number in the Pescara Business Register PE74458.

These general conditions (hereinafter "General Conditions"), except for any exceptions specifically agreed in writing, govern the relations between JEUNESSE S.R.L. (hereinafter "JEUNESSE") and the customer, consumer or professional (hereinafter "Customer").

In order to purchase through our website, the following conditions are required:

- Be over 18 years of age

- Have a personal and valid email address

- Possess the requirements to access and enter into legally binding contracts

- Possess a credit card for certification and payment: American Express, Visa, Master Card, Paypal, or have a Bank/Current Account to arrange a Bank Transfer.

The Site is exclusively aimed at users who are "end consumers", that is, any natural person who acts within the Site for purposes not related to their commercial, entrepreneurial or professional activity, possibly carried out.

Conclusion of the Contract

1. For the conclusion of the purchase of one or more products on the Site, it is necessary to register the user, with the consequent acceptance of all the sales clauses.

Having verified the correctness of the payment, the veracity of the personal and shipping data, as well as the availability of the product ordered, JEUNESSE will consider the order accepted and will confirm by email the receipt and execution of the order with all the related information. The contract stipulated between JEUNESSE and the Customer must therefore be considered concluded with the acceptance of the order by JEUNESSE and, in each case, subject to successful payment.

2. Once the online purchase procedure has been completed, the Customer will print or save an electronic copy and, in any case, keep these General Conditions and, if the Customer is a consumer, also in compliance with the provisions of articles 52 and 53 of Italian Legislative Decree no. 206 of 6 September 2005 ("Legislative Decree no. 206/2005").

Method of purchase

3. The Customer may purchase online only the products in the electronic catalogue published on the Website ("Products") and reported as available at the time of placing the order, as described in the relative information sheets that can be viewed there. It is understood that the measurements, weights, dimensions and performance indicated in the information sheet are approximate values and that the image accompanying the description sheet of a Product may not be perfectly representative of its real characteristics due to the effect of the Internet browser, the monitor used or other reasons not attributable to JEUNESSE but differ in color, size, components and/or accessories present in the figure.

4. The receipt and acceptance of the order is confirmed by JEUNESSE by e-mail, sent to the e-mail address communicated by the Customer at the time of registration in the reserved area of access to the Site or at the time of completion of the electronic form relating to the transmission of the order. This confirmation message will show the date and time of receipt of the order and a Customer Order Number, to be used in any further communication with JEUNESSE. The response message from JEUNESSE will contain a summary of the order placed, all the data entered by the Customer and the General Conditions. The Customer undertakes to verify its correctness and to promptly communicate any corrections, in the manner described in the message itself. It is not possible under any circumstances to request changes to orders that have already been confirmed and/or processed. Further orders entered will be processed and shipped separately.

5. The assortment on the Site reflects the actual availability of each item, by size and color. JEUNESSE, upon receipt of the order request from the Customer, reserves the right to confirm the availability of the purchased items, as well as to verify the validity of the transaction by credit card and the details of the previous transactions carried out by the Customer on the Site. If the items ordered are not available, or for any reason JEUNESSE cannot process the Customer's order, JEUNESSE will immediately send a communication to the Customer by e-mail. In particular, in the case of products no longer available, or for sale at the time of the last access to the site (or the sending of the order form) but subsequently no longer available, it will be the responsibility of JEUNESSE to communicate, promptly and in any case within thirty (10) days from the day following the day in which the order was transmitted, the possible unavailability of the products ordered.

In the case of a contract not concluded for any reason, which, however, has already generated a payment of the consideration by the Customer, JEUNESSE will immediately reimburse what has already been advanced by the Customer.

6.We do not refund price differences on products purchased before promotions begin.

Consideration and Currency

6. The fee for the purchase of the Products is that made known to the Customer directly by JEUNESSE through the Site itself and summarized in its total amount in the cart, including VAT.

7. The payment of the Products purchased online by the Customer will be made using the method chosen at the time of the order. Nothing will be owed more by the Customer than the total of the order highlighted at the end of the purchase procedure. In case of acceptance of the order of Products to be delivered outside the Italian territory, the amount corresponding to the cost of the Products ordered will be increased - in addition to the shipping costs - of the taxes, if required by the legislation of the country of destination of the Products purchased.

8. The official currency of the Site is the Euro. For countries that are not members of the Euro, the exchange rate depends on the tax rates currently applied by the institution issuing the credit card or form of payment used (i.e.PayPal). Payments and all monetary transactions take place in Euro. Prices and exchange rates with other currencies other than the Euro have only an indicative value to help the user to have a greater perception of values: the prices of the products could therefore be subject to updates and are in any case subject to current taxes. The amount that will be charged to the customer's credit card or Paypal account may vary from that indicated at the time of order as it is based on daily exchange rates and bank fees. JEUNESSE s.r.l. invites customers to contact their bank to request detailed information on exchange rates and bank fees related to their transaction. The user must always verify the accuracy of the final sales price before submitting the relevant order form.

Payment methods

9. Payments for Products purchased under these general conditions may be made exclusively in one of the following ways: credit card, bank transfer, PayPal card (www.paypal.it).

(b) In the event of withdrawal by the Customer, pursuant to Legislative Decree no. 206/2005, or non-acceptance of the order by JEUNESSE, the latter will promptly request the cancellation of the transaction and the release of the amount committed.For some types of cards, the release times depend exclusively on the banking system and can reach their natural expiration (24th day from the authorization date).

(c) JEUNESSE reserves the right to charge the amount of the order placed by the Customer on the latter's credit card, in order to avoid the expiration of the authorization of the transaction as provided for in paragraph (b) above.

(d) JEUNESSE reserves the right to request additional information from the Customer (e.g. landline number or i.d. details) or the sending of a copy of documents proving the ownership of the credit card used. The Customer acknowledges that - in the absence of sending the required documentation - the order may not be accepted.

(e) At no time during the purchase process is JEUNESSE able to know and record the information relating to the Customer's credit card, transmitted via a secure connection (notarized) directly to the bank that manages the transaction without any transfer to the servers and databases of JEUNESSE or other third parties other than the bank itself. The electronic transaction relating to the payment of the fee is in fact completed by redirecting the Customer to a page outside the JEUNESSE website, managed directly by the bank chosen for the management of online payment services. At the end of the electronic transaction for the payment of the fee, the Customer will be automatically reported on the page of the JEUNESSE Website where they can take note of the actual conclusion of the transaction.

By virtue of the foregoing in the previous paragraph, no JEUNESSE computer archive will store data, neither at the time of the transaction nor subsequently. In no case JEUNESSE can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, when paying for Products purchased on the Site.

In order to guarantee greater protection on purchases made online, JEUNESSE S.R.L. recommends its Customers to join the Verified By Visa or Mastercard Securecode services, requesting a PIN security code with which to make their purchases in total safety. (f) In cases of payment of the fee by the Customer by credit card, JEUNESSE cannot be held responsible for the outcome of the transaction, which depends exclusively on the third party provider of the online payment service and which, in any case, will be chosen among the main operators in the sector at national level.

(g) The Customer acknowledges that the forwarding of the purchase order and the payment of the consideration takes place through electronic communication networks and services whose correct operation is outside the control of JEUNESSE, for which it cannot therefore answer in any way.

9.2 Bank Transfer

(a) In case of payment of the Products by means of a bank transfer, in the confirmation of the Customer's order - sent by email by JEUNESSE as indicated in article 4 above - the bank details to be used for payment will be indicated. The Products subject to the Customer's order will be reserved in this case pending the crediting of the corresponding amounts to the JEUNESSE current account.

(b) The bank transfer must be made within 3 working days from the registration of the order. If we do not receive the payment or the accountant within this period of time, we will proceed with the cancellation of the order.

(c) In any case, the Customer will be required to send JEUNESSE - within 24 hours of receipt of the order confirmation by email to info@jeunesseboutique.com - a copy of the transfer order made in favor of the latter including the CRO number. In the absence of receipt, within the aforementioned period of 24 hours, of a copy of the bank transfer, JEUNESSE will no longer be required to guarantee the availability of the goods ordered and the shipment of the goods will be conditioned on the actual availability of the same at the time of crediting the amount transferred.

(d) The shipment of the Customer's order will be made once JEUNESSE has received the actual credit on its current account of the amounts corresponding to the order itself.

9.3 Pay Pal Card Payment

(a) In the case of using the Pay Pal card payment method, the Customer can make the payment of the order directly through their verified Pay Pal account. JEUNESSE informs that payments made and coming from verified accounts will be accepted exclusively and reserves the right to ship the Products subject to the Customer's order to the address indicated on the verified Pay Pal account.

(b) Payments for orders of Products from non-true Pay Pal accounts will be cancelled and, consequently, not processed by JEUNESSE.

Delivery methods and costs – Invoicing

10. The Products ordered will be sent to the address indicated by the Customer at the time of registration in the reserved area of access to the Site or - if different - to the address indicated in the relative order, preferably within the Italian territory. The customer acknowledges that the request for delivery of Products outside the Italian territory may result in the non-acceptance of the order by JEUNESSE. JEUNESSE does not ship to PO Boxes or Post Stop. Requests for orders to these addresses will be automatically canceled.

The delivery status of the order will be visible to the Customer through access to the Site and consultation of the reserved area in the appropriate section containing the historical archive of purchases made by the Customer on JEUNESSE website.

11. For each order placed on the Site, JEUNESSE will issue a non-tax document relating to the Products shipped, sending it to the order holder both by e-mail, pursuant to art. 14 of Presidential Decree 445/2000, both inside the package containing the Products. For the purposes of issuing this document, JEUNESSE relies on the information provided by the Customer in the order form and at the time of registration in the reserved area of access to the Site. Once the non-tax document has been issued, it will not be possible to make any changes to the data entered therein.

12. The delivery costs, as explained on the Website and in the text of the order, are borne by the Customer. Please refer to the "Shipping Information" section for any further details.

13. Orders will be shipped from Monday to Friday. Orders placed on Saturdays, Sundays or other public holidays or pre-holiday days will be processed by JEUNESSE starting from the first working day following that on which they were placed.

14. The delivery to the Customer of the Products subject to the order will be carried out through JEUNESSE customized packaging to protect the packaging originally provided by the manufacturer, which will be entrusted to a specially appointed courier. The communication to the Customer of which courier will be in charge of the delivery will be carried out in the manner provided on the Site. No responsibility can be attributed to JEUNESSE in case of delay in the delivery of the ordered goods.

15. At any time, the Customer can check the progress and shipment of their order by accessing the reserved area of the Site or directly to the link of the site of the chosen shipper, by matching the 'Customer Order Number' assigned at the time of order confirmation and the ‘TrackChange Number’ (or similar instrument) assigned to each individual shipment.

16. The contractual provision of jeunesse to the Customer is considered fulfilled at the time and at the place where the Products purchased by the latter are delivered by JEUNESSE to the courier chosen for delivery.

Delivery by the courier of the ordered Product is on the street level of the Customer, unless otherwise communicated by the Customer Service.

17. Upon delivery by the courier of the purchased Product, the Customer is required to check:

- that the number of packages delivered corresponds to the number indicated in the transport document sent in advance by e-mail;

- that the packaging is intact, not damaged or wet or otherwise altered, including the sealing materials (adhesive tape or metal straps).

Any damage to the packaging and/or to the Product or the lack of correspondence of the number of packages or indications, must be immediately contested by the Customer, placing A WRITTEN CONTROL RESERVATION (SPECIFYING THE REASON FOR THE RESERVATION, e.g. "laundered packaging", "crushed packaging", etc.) on the proof of delivery of the courier. Once the courier's document has been signed without any reason specified in the proof of delivery, the Customer will not be able to object to the external characteristics of what has been delivered.

18. In the event of non-collection within 5 working days of the Product in stock at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the Product ordered will be returned to the JEUNESSE warehouses.

Customer's Right of Withdrawal

19. Pursuant to art. 64 of Legislative Decree no. 206/2005, the Customer who has the status of consumer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, in the terms and in the manner indicated in the following articles.

If the terms and conditions prescribed for the exercise of the right of withdrawal, as specified in this paragraph and in the following articles, are not respected, the customer will not be entitled to reimbursement of the sums already paid to JEUNESSE; however, the customer may obtain the products in the state in which they were returned to JEUNESSE at his own expense. Otherwise, JEUNESSE may retain the products, in addition to the sums paid for their purchase. After 3 months from the date on which the garments are made available to the Customer for possible collection, the garments will be destroyed or in any case destined for disposal without any further communication or request for consent to the Customer.

20. To exercise the right of withdrawal referred to in Article 19 above, the Customer must send JEUNESSE a notice to this effect, within 14 working days from the date of receipt of the Products with respect to which the right of withdrawal is exercised. Such communication may be sent through the management of returns in your reserved area of the site and MUST be received by us within the aforementioned period of 14 working days from the date of receipt of the ordered Products.

21. Once the aforementioned notice of withdrawal has been received, the Customer will be promptly informed of instructions on how to return it, assigning a unique RMA (Return Merchandise Authorization) code for the return of the Product (s), which must be carried out strictly with the packaging initially used for delivery, to the address and with the courier specified in the RMA. For the purpose of the acceptance of the withdrawal by JEUNESSE, the Customer must print and attach to the shipment the document of acceptance of the RMA unique return code previously received by JEUNESSE. The Product in return must reach JEUNESSE within 10 days from the date of receipt by the Customer of the RMA authorization notice sent by JEUNESSE. For this purpose, the date of delivery to the post office or to the freight forwarder shall apply.

22. The Product purchased must be returned intact, not used, washed or otherwise altered, complete with all its parts, equipped with the related control tag or any disposable seals and in the original packaging (including original packaging and boxes, and any accessory material, such as, for example, dust bags, hangers and clothes covers) as originally sealed by the manufacturer. To limit damage to the original packaging of the Product, it is recommended to insert it inside the box with which the goods were initially shipped, on which to affix the label provided by JEUNESSE bearing the RMA number (return authorization code); it is imperative to avoid in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product.

23. The return shall be at the expense of the customer. Furthermore, the costs of delivery to the Customer and any other ancillary costs and/or taxes and/or customs charges highlighted at the time of placing the order will not be reimbursed. The shipment, until the certificate of receipt in the JEUNESSE warehouse, is under the complete and total responsibility of the Customer.

24. The right of withdrawal applies exclusively to the Product purchased in its entirety; therefore, it is not possible to exercise withdrawal only on one or more parts of the Product purchased. In the case of orders including several Products, it will be possible to exercise the withdrawal in relation to one or more Products of the order, specifying the description of the Products that you intend to return, in the notice of withdrawal, pursuant to the previous article 20.

In the event of damage to the Product during transport, JEUNESSE will notify the Customer of the occurrence (within 3 working days of receipt of the Product in its warehouses), to allow it to promptly file a complaint against the courier or carrier and obtain a refund of the value of the Product (if insured); in this case, the Product will be made available to the Customer for its return, at the same time cancelling the withdrawal request.

JEUNESSE is not liable in any way for damage or theft/loss of the Products.

Upon arrival at JEUNESSE warehouses, the Product will be examined for any damage or tampering not resulting from transport. If the labels and/or tags of the Product (s) (both those sewn to the product and those usually removed before using the product (s) themselves), the original packaging (including any additional accessory packaging material) are found to be damaged, JEUNESSE will deduct from the refund due a percentage, in any case not exceeding 10% of the value of the Product itself, as a contribution to the restoration costs.

25. Without prejudice to the shipping costs, taxes and any customs charges incurred for the delivery of purchased products and any recovery costs withheld as a contribution to the restoration of damaged products to the original packaging, JEUNESSE will reimburse the Customer the amount already paid for the purchase of the Product in the shortest possible time, in any case within 10 working days from the date of its return to JEUNESSE warehouses. In the case of payment made by credit card, the refund will be made through transfer of the amount charged to the credit card or by bank transfer. In the latter case, it will be the Customer's responsibility to promptly provide the bank details to which the reimbursement will be addressed (Cod. ABI - cab - IBAN - Bank account number and supporting bank of the invoice holder).

If the product recipient indicated on the order form does not match the person who made payment for the amounts due for their purchase, JEUNESSE will make the refund – in the event that the right of withdrawal is exercised – to the person who made payment.

The actual time for crediting or returning the amounts paid for the purchase of the products depends on the payment methods used:

- purchase by credit/debit card: the refund time depends on the credit/ debit card, but normally takes place within two bank statements;

- purchase by bank transfer: the refund is made to the current account from which the transfer was made;

- purchase via PayPal: the refund is made to the PayPal account and is immediately visible from the moment JEUNESSE accepts the return. The actual refund to your credit card on your PayPal account ultimately depends on the company that issued your credit card, but it usually happens within 30 days.

26. The Customer loses the possibility of exercising the right of withdrawal, due to lack of the essential condition of integrity of the Product (packaging and/or its content), in cases where JEUNESSE ascertains:

- even partial use of the Product and any accessories;

- lack of external packaging and/or original interior packaging;

- any components of the product are missing;

- he absence of the control tag attached to the Product or other disposable seals;

- the product has been damaged by causes not linked to shipping.

In such cases, the Products will remain in storage at the JEUNESSE warehouse at the Customer's disposal for collection at their expense.

Warranties

27. All Products sold through the Site are covered by the manufacturer's warranty for lack of conformity, for a duration of 12 months if the Customer is a professional operator (and, as such, has a VAT number), and for a duration of 24 months if the Customer is a consumer, as provided by Legislative Decree no. 206/2005.

28. The manufacturer's guarantee is given in accordance with the terms of law.

29. The warranty applies to the Product that has a lack of conformity, provided that the Product itself is used correctly, in compliance with its intended use and the provisions of the attached documentation. In the event of a lack of conformity, JEUNESSE will, at no cost to the Customer, restore the conformity of the Product by repair/replacement or reduce the price or terminate the contract. If, as a result of checks by JEUNESSE, the defect does not appear to be a defect in conformity, the Customer will be charged for any costs of verification and restoration, where applicable, as well as transport costs if incurred by JEUNESSE.

In case of return due to manufacturing or shipping defects, the shipping costs will be borne by JEUNESSE only if our reference courier, appropriately notified, is used for this purpose.

30. In the event that, for whatever reason, JEUNESSE is unable to provide the Customer with a Product under warranty (either repaired or replaced), the Seller may proceed at their own discretion with the return of the amount paid taking into account the use of the Product or with its replacement with a Product of equal or superior characteristics.

31. The repair or replacement times of the defective Product depend exclusively on the policies of the manufacturer and no damage can be claimed from JEUNESSE for any delay in carrying out repairs or replacements.

32. In cases where the application of the warranties provides for the return of the Product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging, material, packaging accessories and any documentation and accessories). In order to limit damage to the original packaging, JEUNESSE recommends inserting it into the box sent with the initial shipment.

Personal Data Protection

33. Under Article 13 of the Legislative Decree 196/2003 and subsequent amendments and additions, JEUNESSE, as Data Controller, informs the Customer that the personal data provided by the same and acquired at the same time of (i) registration in the reserved access area of the Site, (ii) the conclusion of an online purchase contract through the Site of any product, (iii) at the time of navigation on the Site through the so-called "logs" of the system, will be processed, by manual, IT and telematic tools for the purposes indicated below:

1. the performance by JEUNESSE of the activities necessary for the conclusion, management and execution of the contracts for the purchase of products through the Website under its own ownership;

2. for purposes strictly connected and/or necessary to the satisfaction of requests made, from time to time, by the user through the Site or by e-mail or other means of communication;

3. the execution of obligations provided for by laws, regulations and Community legislation as well as provisions issued by authorities legitimized by law or by supervisory and control bodies;

4. sending newsletters and promotional material concerning the products offered by JEUNESSE With reference to the purposes indicated above, JEUNESSE informs that the provision of data is mandatory for the purposes under 1), 2) and 3), with the consequence that, in such cases, a possible refusal to provide will determine the impossibility for JEUNESSE to satisfy and fulfill the orders or requests of customers.

In view of the above, with reference to the processing referred to in paragraph 4 above), JEUNESSE S.r.l. informs that with (i) registration on the Site, (ii) the online compilation of the order and the consequent conclusion of the purchase contract, (iii) the request for information about products and services offered by JEUNESSE S.r.l., whatever the form and the means by which this request is forwarded by the user to the company, (iv) browsing the Site through the so-called "logs" of the system, the Customer expressly gives his/her consent and declares to accept the simultaneous subscription to the newsletter for the sending of promotional material concerning the products and services offered by JEUNESSE S.r.l., without the latter from time to time requiring the user to consent to the execution of this type of processing.

By virtue of the preceding paragraph, JEUNESSE S.r.l. will be expressly authorized by the user to send newsletters and promotional material concerning the services and products offered by JEUNESSE S.r.l.,without the need for any further and prior request for authorization by the user himself, at the time when the latter (i) registers on the Site, (ii) concludes a purchase contract with JEUNESSE S.r.l., (iii) requests information about the products and services offered by JEUNESSE S.r.l., both in written and oral form through any means of communication, (iv) navigates the site through the so-called "logs" system.

The processing of personal data by JEUNESSE takes place with logic strictly related to the purposes indicated above and, in any case, in order to guarantee the security and confidentiality of the data. In addition, personal data may be communicated - for the purposes referred to in points 1), 2) and 3) - to various JEUNESSE subjects, who will process them as independent data controllers or data processors. In any case, personal data will not be disclosed.

The data will be stored within the EU.

Finally, JEUNESSE informs that Article 7, Legislative Decree 196/2003, confers on the Customer who communicates his/her specific personal data rights, among which, that of obtaining from the owner or manager, if appointed, confirmation of the existence or not of his/her personal data and that such data are made available to him/her intelligible information, to know the origin of the data as well as the logic and the purposes on which the processing is based, to obtain the cancellation, transformation into anonymous form or the blocking of data processed in violation of the law, as well as updating, rectification or, if there is interest, integration of the data; opposing, for legitimate reasons, the processing itself.

In order to become aware of changes or modifications in the policies relating to the protection of personal data carried out by JEUNESSE, mainly due to regulatory changes, it is appropriate that the Customer constantly consults this document.

Applicable Law

35. These General Terms and Conditions of Sale are governed by Italian law.

CONSENT

Pursuant to and for the purposes of articles 1341 and 1342 of the Civil Code, we declare to expressly accept the provisions of articles: 3 (summary description of the Products in the catalogue); 5 (non-fulfilment of the order); 8.1, lett. e (absence of liability regarding the fraudulent use of the Customer's credit card); 8.1, lett. f (absence of liability regarding the successful payment online); 8.2, lett. b (reservation of cancellation of the order in the absence of receipt of a copy of the bank transfer within 48 hours); 8.3, lett. b (reservation of cancellation of the order in case of payments coming from unverified Pay Pal accounts); 11 and 22 (delivery/shipping costs and taxes to be borne by the Customer); 15 (fulfillment of JEUNESSE's obligation at the time of delivery of the Product to the chosen shipper); 16 (burden of control of the Products delivered by the Customer); 17 (acceptance of the Product without reservations by the Customer, in the absence of disputes); 23 (10% charge reserve in case of damage to the returned Product); 25 (reservation of refusal to accept the returned product); 32(privacy) and 34 (applicable law), of these General Conditions.
